The Labour Party governorship aspirant in Edo state, Kenneth Imansuangbon, has appealed the Court of Appeal against the party’s standard bearer, Olumide Akpata, and the Independent National Electoral Commission.
Imansuangbon, a billionaire industrialist, is dissatisfied with the judgments of two Federal High Courts, which dismissed his applications on July 15 and 22, 2024.
He is seeking an order to set aside the decision of the lower court and direct INEC to issue him a certificate of return as the winner of the primary election held on February 23, 2024, according to TheNation.
Imansuangbon’s appeal is based on nine grounds, including that the trial judge erred in law and occasioned a miscarriage of justice by describing his suit as statute-barred without considering relevant constitutional provisions.
The LP chieftain is challenging the judgment of the Federal High Court, Benin, which declared that his suit was premature and lacked substantial evidence to support his claims, thereby upholding Akpata’s position as LP’s governorship candidate in Edo.
